These Terms of Service are an agreement between you and WatsapDuka. By creating an account, accessing the website, or using the service, you agree to these terms and any policies referenced here.
2. Account usage
You are responsible for maintaining accurate account information, protecting login credentials, managing user permissions, and all activity under your account. You must notify us promptly if you suspect unauthorized access.
3. Subscription terms
WatsapDuka may offer free trials, paid plans, usage-based limits, add-ons, and custom enterprise agreements. Fees, WhatsApp limits, user limits, order limits, billing periods, and included features may vary by plan and country. Unless otherwise agreed, subscriptions renew until cancelled.
4. Payments and billing
You agree to pay applicable fees, taxes, and charges for your selected plan. Payment failure may result in account restrictions, suspension, or downgrade. We may update pricing with reasonable notice where required.
5. Acceptable use policy
You must not use WatsapDuka to:
- Send spam, misleading messages, unlawful content, or abusive communications.
- Sell illegal, restricted, counterfeit, unsafe, or prohibited goods or services.
- Violate customer consent, privacy, consumer protection, or messaging laws.
- Attempt to bypass security, access another tenant's data, or disrupt the service.
- Upload malware, scrape the service, reverse engineer the platform, or misuse APIs.
6. WhatsApp policy compliance
You are responsible for complying with WhatsApp Business Platform requirements, Meta policies, message template rules, opt-in and opt-out requirements, commerce restrictions, and applicable laws. WatsapDuka may restrict features or suspend messaging where needed to protect the platform or comply with provider policies.
7. Customer data and consent
You represent that you have the rights and permissions needed to upload, process, message, and manage customer data through WatsapDuka. You are responsible for honoring customer requests, including opt-outs and deletion requests, where applicable.
8. Service availability
We aim to provide reliable service, but availability may be affected by maintenance, internet outages, hosting providers, payment providers, WhatsApp or Meta platform availability, and events outside our control.
9. Intellectual property
WatsapDuka owns the platform, website, product design, software, and related intellectual property. You retain rights to your business data, customer data, product data, and content you submit to the platform.
10. Limitation of liability
To the maximum extent permitted by law, WatsapDuka is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, service interruptions, or third-party platform failures. Our aggregate liability is limited to the amount paid by you for the service during the three months before the event giving rise to the claim.
11. Termination policy
You may stop using the service or request account deletion at any time. We may suspend or terminate accounts for non-payment, security risk, policy violation, unlawful activity, or misuse. Upon termination, access may stop immediately, but we may retain data as required for legal, security, backup, or business record purposes.
12. Changes to terms
We may update these terms as the service evolves. We will update the date above and provide notice where appropriate. Continued use after changes means you accept the updated terms.
